Starting your own business is one of the great challenges one will ever experience in life. It can be exciting, rewarding, frightening and tricky all at the same time. For new business owners, there are so many things that you must learn about the business and how it works. To help understand the start-up process, here are some easy steps.

Steps You Can Follow:

You must first decide what kind of business to start. It’s important to determine your passion and goals. Also, decide on the structure of your business.

Make a business plan. A business plan will allow you to gain a better understanding of how your business will be, how to handle the competition, it will outline the steps you need to take, your goals, etc. A business plan is essential for your success and growth as an entrepreneur.

Choose the right name for your business. When choosing a name for your business, it helps to know that the right business name will help distinguish you from other competitors. Keep it simple and easy for your customers to remember. Your business name should have in it a reflection of what you do. Carefully choose a name that will also meet the state and local requirements.

Open a business bank account.

Apply for your Tax ID Number. This will act as your unique business identifier on all types of registrations and documents.

Determine if there are any local licenses and permits needed to open your business.

Determine your business location. Choosing the right location for your business can be a major factor for its success or failure. Make sure you know all the legal restrictions of your place of business.

Get Business Insurance. Business insurance is a necessity and not an option. A business owner has the responsibility to manage the risks involved with your business. Protect your company in the event of disaster or litigation

If you or someone you know wants to start-up on a business, you can also seek the advice of an experienced business lawyer.

Traumatic brain injury (TBI) is brain damage sustained from external mechanical force, where brain function is temporarily or permanently affected and impaired. This brain injury is an acquired type of injury, that is, sudden physical trauma to the gray matter not caused by hereditary, congenital, or degenerative conditions. TBIs are usually classified and treated according to cause, category, and complication.

Causes and Causative Forces

The most common occurrences that lead to traumatic brain injury include violence and accidents related to transportation, construction, and sports. In the US, between 1.6 and 3.8 million traumatic brain injury cases are a result of sports and recreation activities, while bicycle and motorcycle accidents are major vehicular accidents leading to head trauma. Among children, child abuse causes 19% of brain injury cases, with a high death rate among such instances.

Forces involved in such forceful occurrences leading to brain trauma include angular, rotational, shear, and translational forces. Contact or impact loading, where the head strikes or is struck by something, is usually responsible for focal or regionalized injuries, while noncontact or inertial loading causes diffuse injuries, which are distributed in a more general manner.

Categories

Categorization of brain injuries can be mild, moderate, and severe. The most commonly used classification system is the Glasgow Coma Scale (GCS), which grades the person’s level of consciousness based on verbal, motor, and eye-opening reactions to stimuli. The lower the person’s standing is on the GCS scale, the more severe the injury. As well, duration of post-traumatic amnesia and loss of consciousness are also evaluated. For these additional criteria, the higher the values, the more severe is the person’s condition.

Complications

While most mild TBI cases do not cause permanent or long-term disability, all brain injury severity levels have the potential to create complications.

Medical problems that result from TBI include a broad range of physical, cognitive, emotional, and behavioral complications. Effects on consciousness include coma, brain death, and even a persistent vegetative state. Meanwhile, trauma to blood vessels can result in vasospasms and aneurysms.

Movement disorders associated with brain trauma often affect coordination and muscle function and also increases susceptibility to seizures. Cognitive deficits that can follow injury include language problems, disrupted judgment, memory loss, and problems in executive functions. Emotional or behavioral impairments generally involve depression, anger, irritability, mania, emotional instability, and increased predisposition to psychiatric disorders. The worst of these problems often characterize chronic TBI.

Drivers who want to operate trucks are required to have specialized training. It is not enough to have a regular driver’s license. Truck drivers have to go through extra training and pass written and road tests before they can begin their careers. The written tests include trucking laws and driver regulations. They will learn in their training that they are required to obey all laws in every state that they pass through.

In addition there are many federal laws that govern truck drivers. These cover everything from safe driving techniques, pre-trip checks, and training programs. Some attorneys who deal with truck accident laws consider these eleven federal trucking laws to be the most important. The full details of these laws are found on the Federal Motor Carrier Safety Administration website.

1. Commercial Motor Carrier Safety Assistance Program-Part 350

Pertains to various safety training programs on topics including size and weight enforcement, drug enforcement, traffic safety

2. Controlled Substances and Alcohol Use and Testing-Part 382

Contains detailed rules regarding substances and alcohol testing and penalties for truck drivers

3. Qualifications of Drivers-Part 383

Refers to the qualifications a truck driver must have. These include testing and licensing procedures, driver disqualifications, employer’s responsibilities, and required knowledge and skills

4. Commercial Driver’s License Standard; Requirements and Penalties-Part 383

Refers to the person who holds the license and the level of the license (CDL for commercial driver’s license)

5. Driving of Commercial Motor Vehicles-Part 392

Covers general driving, including railroad crossing, stopped vehicles, use of lights and reflectors, fueling precautions, and prohibited practices

6. Parts and Accessories Necessary for Safe Operation-Part 393

Pertains to the parts and equipment needed on trucks including lighting, wiring, brakes, fuel systems, coupling and towing devices, emergency equipment, frames, cabs, and body components, securing loads

7. Hours of Service of Drivers-Part 395

Pertains to maximum hours allowed, also the detailed log that truck drivers must maintain, recording their actions, or change of status, for each twenty four hours they are on duty. The status includes Driving, Sleeping, On Duty-Not Driving. This log can be kept in a specific form or can be entered into an automatic onboard recording device

8. Transportation of Hazardous Materials; Driving and Parking Rules-Part 397

Pertains to regulations on the transportation of hazardous materials, required driving techniques, and rules for parking with hazardous loads

9. Inspection, Repair, and Maintenance-Part 398

Pertains to the truck driver’s required pre-trip check of the complete truck to ensure safe and proper operating condition

10. Transportation of Migrant Workers-Part 398

Pertains to the transportation of migrant workers, including sections on non-residents

11. Employee Safety and Health Standards-Part 399

Pertains to safety practices including step, handhold and deck requirements, truck access requirements, and maintenance

The complete text of these eleven federal regulations are detailed and complex. This is one reason why truck drivers must continue their training throughout their career in order to keep up with current trucking laws. Often this is handled through regular training programs.

Nursing home services will include the services of nurses, nursing assistants and aides; speech therapists; occupational therapists; physical therapists; recreational assistants; social workers as well as room and board. Most of the care that is provided in a nursing facility is given by certified nurse’s aides and not by actual skilled professionals. For example, in 2004 there were 40 certified nursing assistants per 100 nursing home beds, on the average. Licensed practical nurses (LPNs) numbered 13 per 100 beds while registered nurses numbered 7 per 100 beds, on the average.

Federal Staffing Laws

For those nursing homes that wished to participate in Medicaid and Medicare programs, and as such are required to abide by federal laws regarding staffing, 98.5% of the 16,100 facilities nationwide qualified for one or both programs.

Medicare

Medicare coverage will provide for 20 – 100 days of nursing home services for those beneficiaries who require additional care or rehabilitation immediately after hospitalization of at least 3 consecutive days. Medicare will not, however, provide for exclusive custodial care. Custodial care involves only needing assistance with walking, bathing or transference from a bed to a chair, for example. For Medicare nursing home coverage, a patient must be certified by a physician who will state that the daily skilled nursing care needed is related to the hospitalization. For example, a patient just released from a hospital after suffering a stroke or a patient requiring wound care after a surgical procedure.

Different Types of Facilities

Skilled Nursing Facility services can be offered either in a dedicated free-standing facility or a hospital-bed setting. Free-standing facilities are those which usually provide Medicare-related services, as well as long term care for those who pay for their services out-of-pocket (either through privately held assets, Medicaid or long-term care insurance policies). Usually, Medicare patients will make up a minor portion of a nursing home’s residents.

Road accidents can be classified in several ways, from the type of vehicle involved to the severity of the crash. For most purposes, however, accidents are classified according to cause and mechanism. This gives rise to literally dozens of car accident types. Most of them fall under five main types: head-on collisions, run-off-road collisions, rear-end collisions, side collisions, and rollovers.

Head-on collisions
A head-on collision occurs when two vehicles hit each other at the front ends. The vehicles involved are usually traveling at high speeds, and as the collision doubles the force of the crash, head-on collisions are often fatal. However, they are also among the least common on U.S. roads: in 2005, they accounted for a mere 2% of all road accidents but caused over 10% of resulting deaths.

Run-off-road collisions
A run-off-road collision involves a single vehicle that deviates from the road and either rolls over or hits a fixed object. These collisions often result from drivers misjudging curves, losing control of the wheel, or swerving to avoid another collision. Striking a solid object, such as a pole or a tree, increases the severity of the crash. In 2005, run-off-road collisions accounted for 31% of fatal crashes and 16% of all road accidents.

Rear-end collisions
In a rear-end collision, one vehicle hits another from the back. This often occurs when the vehicle in front suddenly slows down (usually to give way to pedestrians) and leaves little or no time for the other vehicle to brake. While not as fatal as the previous two, rear-end collisions commonly cause whiplash, a neck injury caused by sudden acceleration-deceleration without any external force.

Side collisions
Side collisions occur when one or more vehicles are hit by another from the side. They usually happen wherever vehicles move in different directions, such as intersections and parking lots. A sub-type, called a broadside or T-bone collision, occurs when the front or rear of one vehicle hits the side of another. In this case, injuries tend to be more severe, although it largely depends on the speed of the vehicles involved.

Rollovers
Relatively uncommon but often severe, rollovers occur when a vehicle turns over sideways or upside down. This often happens when a vehicle is hit by another or turns sharply while moving at high speed. Rollovers often result in severe head injuries to the passengers and are among the most fatal of crashes.

When a person is charged with a case under DWI or Driving While Intoxication, his top priority is to find a lawyer who is well experienced in handling such cases and DWI Attorney can effectively work under Dallas Criminal Defense Law. These days, DWI Laws are getting more unsympathetic than before and leave people with a black mark on their criminal records. While appointing DWI Attorney for the same, people should always make sure that the lawyer is well versed with the changing DWI Laws and can handle the case effectively. If a person has never undergone such a situation before, he might face difficulty in choosing the DWI Attorney for defending his case.

Field Sobriety Tests

Field Sobriety Tests are used by the police to check the ability of the driver for safe driving. These tests are conducted to check balance, steady reactions, small muscle control, short term memory and many other aspects. When the police use Field Sobriety Tests, they take into account Horizontal Gaze Nystagmus Tests, Walk & Turn Tests and One Leg Tests out of which a good Field Sobriety Test should confirm two to three features accurate. In these tests, police comes to know about various things like unbalancing during instructions, stepping off line, losing balance, taking wrong steps, stopping in the middle of the tests often and lots more.

However, these tests are not 100% accurate, but if a person is charged for these tests and has been arrested or investigated for the same, he needs a lawyers who can defend the case. The DWI Attorney who is familiar with Dallas Criminal Defense Law can be of great assistance to the people where they can seek advice and can also appoint them for defending the case.

Hiring an Experienced Lawyer

Hiring an experienced legal representative is very important for explaining the rights of the convict and fighting for the same. People need to understand that a lawyer who is practicing under DWI is not always experienced, so clients should always make sure that their lawyer is skilled enough with regards to the modifying laws. The DWI Attorney should investigate the case thoroughly for legal defense, inquire about the facts that have not been disclosed, maintain a case file and record and should provide apt time to the case of the client. If a lawyer is able to defend the case aptly, then it will facilitate the client to keep his criminal record clean, otherwise it can affect the personal and professional life of a person, negatively.

Most lawyers deal in various DWI practices which include alcohol and minors, breathalyzer and blood tests, intoxication manslaughter, flying while intoxication, boating while intoxication, minor in possession and lots more. Legal representatives who have been practicing criminal defense under DWI and are well experienced in this field can better defend the case and fight for all the rights of the convict. So, if you have also been facing the same difficulty, appoint a DWI Attorney and seek for justice.

The penalties for a DUI in Texas are based on the number of times the underage driver has offended.

First Offense (Class C Misdemeanor):

30 day suspension of driver’s license

Up to $500 fine

Between 20 and 40 hours of community service

Must attend alcohol-awareness classes

Second Offense (Also a Class C Misdemeanor):

120 day suspension of driver’s license

Up to $500 fine

Between 40 and 60 hours of community service

May have to attend more alcohol-awareness classes

The third offense penalties change depending on the age of the offender. No matter what age they are their license will be suspended for 180 days. If they are 17 or older it is considered a Class B Misdemeanor and the fine can range from $500 to $2,000. Also, if they are 17 or older they can also face up to 180 days in jail.

When a Minor Can Be Charged with DWI

If someone under 21 years of age is arrested with a Blood Alcohol Content (BAC) of 0.08% or higher they will face the same penalties as an adult driver and will be charged with a DWI instead of a DUI. BAC is determined using a blood or breath test. A DWI has stronger penalties and a driver under 21 years old will face additional charges related to underage drinking.

Underage drinking is a widespread problem in Texas. Texas has different laws for drinking and driving depending on the age and the Blood Alcohol Content of the offender. Texas is a zero-tolerance state, which mean that underage drivers getting caught after consuming any amount of alcohol will be prosecuted for DUI.

Myth: A person can go to the bar and drink anywhere from three to five single-shot drinks and still test negative for a DUI.

Truth: The law says that in order for the average person to stay under the illegal BAC level when driving they can only consume one drink per hour. Even consuming one drink per hour may cause your BAC level to exceed .08, depending on your body type and how often you consume alcohol.

Myth: If the government lowers the legal BAC level then this will lead to less people drinking and driving.
Truth: It doesn’t matter what the illegal BAC level is; there will still be people that drink and drive. It has been calculated, in most DUI arrests the person is far beyond the legal BAC anyways. There are rarely people that drink and keep their BAC level in mind.

The most important lesson to be learned from some of the myths I have featured is that do not drink if you are going to drive. Plain and simple. If you are going out with friends and you plan to consume an abundant amount of alcohol, you need to make certain that you get a designated driver. Getting behind the wheel is a big responsibility that should not be taken for granted no matter what day and age. Think of the innocent lives that we have lost because of the sheer recklessness. Think about your own life and the hurt that your family will be put through if they lose you. Think about your future.

Over the years, alcohol watchdog groups have successfully made the public believe that driving under the influence-related accidents are the major contributors to traffic accidental deaths. Aside from this, the media reports what is far from the truth. In reality only approximately 10% of traffic deaths are caused by drunk driving, not the reported 50%.

The reason for this inflated number is simple. When we hear that an accident is related to drunk-driving, we automatically assume the man who caused the accident was the one drinking. No matter how much or little alcohol he had in his system and the person who caused the accident is sober, it is still seen as an alcohol-related accident. To most of us, alcohol related accidents are accidents caused directly by alcohol. If a man sitting in a parked car has had one drink and another man hits him, this is considered an alcohol-related incident. If a pedestrian who’s had a drink was run over by a car with a sober driver, this is also considered an alcohol-related incident. This should not be the case. This is just one of the many myths surrounding DUI statistics and facts. Here are some more myths and the truths behind them:

Myth: The best way to tell if someone is drunk is by conducting a blood alcohol test.
Truth: People that drink often begins to develop immunity to the strength of the alcohol and because of this their blood may not accurately measure how much alcohol they have actually consumed.
